A prepaid plan must be registered with the North Carolina State Bar before it can operate in North Carolina and before a North Carolina licensed attorney can provide legal services to prepaid plan participants. (See Article 84-23.1 of the North Carolina General Statute.) The North Carolina State Bar does not approve prepaid plans registered with its office. Amendments must be presented in the same way as the initial registration on a form provided by the Public Prosecutor`s Office. In addition, the North Carolina State Low does not have the authority to regulate prepaid plans. However, the North Carolina State Bar regulates the conduct of lawyers who provide legal services to prepaid plan members. Section 84-23.1 of the North Carolina General Act requires all prepaid plans registered with the North Carolina State Bar Association to submit their plan information to the North Carolina Department of Insurance to determine whether the prepaid plan should be regulated by the North Carolina Department of Insurance. 2. The prepaid plan consultant shall inform the plan holder or sponsor of the measures taken by the Public Prosecutor`s Office regarding the registration of amendments within 60 days of receiving them. 3. The Prepaid Office of the Attorney`s Office will review the original registration statement of the plan to determine whether the registration statement is complete and whether the plan, as described in the registration statement, meets the definition of a prepaid legal services plan and otherwise meets the registration requirements of Regulation .0304. 1. An initial registration statement must be filed with the North Carolina State Bar Association addressed to Prepaid Plans Counsel, PO Box 25908, Raleigh, NC 27611.
